PlonHub Terms of Service
§ 1. General provisions and definitions
- These Terms of Service set out the rules for providing services by electronic means within the PlonHub website, including the rules for creating and operating an Account, posting and sharing Content, moderation, and reporting illegal content.
- The Terms are made available free of charge at plonhub.com in a manner allowing them to be obtained, reproduced, and recorded, including downloading and printing.
- For the purposes of these Terms:
- „AUP" (Acceptable Use Policy) — the rules for proper use of the Service and posting of Content, set out in § 7, forming an integral part of the Terms;
- „Channel" — a public profile of a Registered User aggregating the Video Materials posted by that User, together with the Subscription function;
- „Comment" — a textual statement of a Registered User posted under a Video Material, including a statement posted in reply to another Comment;
- „Consumer" — a User who is a natural person performing a legal act not directly related to their business or professional activity, as well as a natural person concluding an agreement directly related to their business activity where the agreement is not of a professional character for them;
- „Account" — a separate set of resources and permissions within the Service assigned to a Registered User, accessible after authentication;
- „Video Material" — a video file together with metadata (title, description, tags, thumbnail, category, licence) posted by a Registered User in the Service;
- „Privacy Policy" — the document setting out the rules for processing personal data and the use of cookies in the Service, available at plonhub.com;
- „Terms" — these terms of service for providing services by electronic means;
- „Service" — the PlonHub website available at plonhub.com, together with its language versions (/pl, /en) and subdomains;
- „Subscription" — the function of following a Channel, enabling receipt of notifications about new Video Materials;
- „Content" — any data and materials posted or transmitted by a User within the Service, in particular Video Materials, their descriptions, tags and thumbnails, Comments, and profile and Channel data;
- „Illegal Content" — content whose posting, storage, or dissemination infringes the law or the provisions of the Terms;
- „Services" — the services provided by electronic means by the Service Provider within the Service, specified in § 3;
- „Service Provider" — the entity indicated in § 2 providing the Services;
- „User" — a natural person, legal person, or organisational unit using the Service, being a recipient of services within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means;
- „Registered User" — a User holding an Account.
§ 2. Service Provider and point of contact
- The Service Provider is Damian Pieszczyński, conducting business activity under the name „Damian Pieszczyński", Al. Jana Pawła II 64/36, 00-170 Warszawa, Poland, Tax Identification Number (NIP) 5242324387.
- The User contacts the Service Provider by electronic means at: rada-starszyzny@plonhub.com.
- The address indicated in section 2 also constitutes the single point of contact for communication with authorities, Users, and persons reporting Illegal Content, including the reports specified in § 11.
§ 3. Type and scope of the Services
- The Service Provider provides, by electronic means, Services consisting in making available the functionalities of the Service enabling:
- browsing and playing publicly available Video Materials without the need to register;
- creating and operating an Account and a Channel;
- posting and publishing Video Materials;
- posting Comments and marking Content with reactions;
- subscribing to Channels and receiving notifications;
- reporting Illegal Content and breaches of the Terms.
- The Services are provided free of charge.
- The Service Provider is entitled to introduce paid Services, paid plans, or advertising functions. The introduction of paid Services will take place upon prior notice to Users, on the terms set out in a separate price list, and the use of such Services will be voluntary and will not change the chargeable nature of the Services the User already uses without the User's consent.
- The Services are of a continuous nature and are available around the clock, except for technical breaks and cases of force majeure. The Service Provider does not guarantee uninterrupted availability of the Service.
§ 4. Technical conditions of use
- Use of the Service requires: a device with Internet access, a current version of a web browser with JavaScript and cookies enabled, and — for creating an Account — an active e-mail address.
- Posting a Video Material requires a file in the formats and with the technical parameters (including maximum size and duration) indicated by the Service at the stage of adding the file, resulting from the streaming infrastructure used to provide the Services.
- The Service Provider is not liable for the User's device or software failing to meet the requirements set out in sections 1 and 2.
§ 5. Registration, Account, and conclusion of the agreement
- The agreement for the provision of Services as regards browsing publicly available Content is concluded upon commencement of use of the Service.
- The agreement for operating an Account is concluded upon registration of the Account and acceptance of the Terms. Acceptance of the Terms is equivalent to having read its content.
- Registration takes place by providing an e-mail address and setting a password, or by authentication using an external provider's account (Google), or by a one-time link sent to the e-mail address. The Service Provider confirms creation of the Account by a message sent to the User's e-mail address.
- A Registered User undertakes to provide true and current data and not to disclose Account access data to third parties.
- An Account may be created by a person who is at least 13 years of age. A person under 16 years of age uses the Account with the consent of a parent or legal guardian; by registering, such person declares that consent has been granted. The Service Provider is entitled to block or delete an Account upon obtaining justified information that the Account is operated by a person under 13 years of age or by a person under 16 years of age without the guardian's consent.
- A User operates one Account, unless the Service Provider consents to operating a greater number of Accounts.
§ 6. User Content and licence granted to the Service Provider
- A Registered User retains all rights to the Content they post. Posting Content in the Service does not transfer to the Service Provider the economic copyright to the Content.
- A Registered User grants the Service Provider a free, non-exclusive licence, unlimited as to territory, to use the posted Content to the extent necessary to provide the Services, including: recording and reproduction by digital techniques, storage, changing the format and technical parameters (transcoding), creating thumbnails and previews, making the Content publicly available in the Service in a manner enabling playback at a place and time of choice, and presenting the Content as part of promotion of the Service.
- The licence referred to in section 2 is granted for the period the Content is maintained in the Service. Upon deletion of the Content by the User, the licence expires, except that the Service Provider is entitled to retain backup copies for the period and to the extent set out in the Privacy Policy, and to retain Content necessary to perform legal obligations or to establish, pursue, or defend claims.
- A Registered User specifies the conditions on which their Video Material may be used by others, by selecting a licence from those available in the Service (the standard licence or an indicated Creative Commons licence). In the absence of a selection, the standard licence applies, which does not entitle other Users to use the Video Material other than by playing it within the Service.
- A Registered User declares that they are entitled to post the Content and to grant the licence specified in section 2, and that the Content does not infringe the rights of third parties or the law.
§ 7. Acceptable Use Policy (AUP)
- The User undertakes to use the Service in accordance with the law, the Terms, and good practice, and not to post Illegal Content.
- It is prohibited to post, store, or disseminate Content which:
- infringes copyright, related rights, or other intellectual property rights of third parties;
- infringes the personal rights of third parties, including content of a defamatory nature;
- constitutes harassment or threats, or incites hatred or violence;
- is of a criminal nature, in particular depicting the sexual exploitation of minors;
- is harmful to minors or unsuitable for persons below the declared recipient age;
- is misleading as to facts, the identity of the author, or the source, in a manner capable of causing harm;
- constitutes unsolicited commercial information (spam) or misleading advertising.
- It is further prohibited to:
- post or disseminate malicious software or initiate attacks on ICT systems;
- attempt to circumvent the technical safeguards of the Service or access restrictions;
- impersonate other persons or entities;
- automatically retrieve data and artificially inflate the number of views, reactions, or Subscriptions.
- In the event of a breach of the AUP, the Service Provider applies the measures set out in § 12.
§ 8. Comments, reactions, Subscriptions, and notifications
- A Registered User is entitled to post Comments, mark Video Materials and Comments with reactions, and subscribe to Channels. The provisions of § 6 and § 7 apply to Comments.
- A Subscription to a Channel enables receipt of notifications about new Video Materials in the Service and — unless the User disables this in the Account settings — notifications sent to the e-mail address.
- A Registered User is entitled to disable the notifications referred to in section 2 in the Account settings.
§ 9. Liability of the Service Provider
- The Service Provider does not exercise general supervision over the Content posted by Users and is not obliged to actively seek it out.
- The Service Provider is not liable for the Content posted by Users, provided that it has no knowledge of its illegal nature and, upon obtaining credible information about the illegal nature of the Content, promptly disables access to it.
- The Service Provider is entitled to voluntarily monitor Content and undertake voluntary verification activities. Undertaking such activities does not remove the exclusion of liability set out in section 2.
- The Service Provider is liable for non-performance or improper performance of the Services on the terms arising from the law. In relation to a User who is not a Consumer, the Service Provider's liability is limited to actual damage and does not cover lost profits. This limitation does not apply to damage caused intentionally.
- The provisions of section 4, second and third sentences, do not apply to a User who is a Consumer; with respect to a Consumer, the Service Provider is liable on the terms set out in the law.
§ 10. Liability of the User
- The User bears full responsibility for the Content they post and for the manner of using the Service.
- In the event that claims of third parties are brought against the Service Provider arising from the User's infringement of those persons' rights or the law in connection with the posted Content, a User who is not a Consumer undertakes to satisfy such claims and to reimburse the Service Provider for the costs incurred in this respect, including legal costs.
§ 11. Reporting Illegal Content (notice and action)
- Any person is entitled to report to the Service Provider Content they consider to be Illegal Content, at the address rada-starszyzny@plonhub.com.
- A report should contain: data enabling contact with the reporting person; an indication of the Content covered by the report in a manner enabling its location, including the URL; an explanation of the reasons why the Content is considered illegal; and a statement of acting in good faith and of the accuracy of the information in the report.
- The Service Provider examines the report without undue delay and informs the reporting person of the decision taken and of the possibility of challenging it. Where the report contains contact details, the Service Provider sends the reporting person a confirmation of its receipt.
§ 12. Moderation and statement of reasons
- Where it is established that Content constitutes Illegal Content or breaches the Terms, the Service Provider is entitled to apply one of the following measures: marking the Content as requiring changes, restricting its visibility, disabling access to the Content, deleting the Content, and — in the case of a Registered User — temporarily suspending or deleting the Account on the terms set out in § 13.
- Of the application of a measure set out in section 1 with respect to the Content of a Registered User, the Service Provider informs that User by electronic means, stating: the measure applied and its scope, the reasons for the decision together with an indication of the breached provision of the Terms or the law, and information about the complaint procedure set out in § 14. The Service Provider may refrain from informing where this would risk frustrating the actions of authorities or breaching the law.
- Where Content breaches the Terms in a manner that can be remedied by the User, the Service Provider may mark the Content as requiring changes and indicate a deadline for remedying the breach.
§ 13. Suspension and deletion of the Account; termination of the agreement
- A Registered User is entitled to terminate the agreement for operating the Account at any time, by deleting the Account from its settings or by submitting a request to the address rada-starszyzny@plonhub.com.
- The Service Provider is entitled to suspend the Account with immediate effect in the event of: a gross or repeated breach of the AUP; conduct endangering the security of the Service or other Users; an official order requiring access to Content to be disabled. The Service Provider informs the User of the suspension and its reason and, in cases enabling the breach to be remedied, indicates a deadline for remedying it.
- The ineffective lapse of the deadline referred to in section 2 entitles the Service Provider to terminate the agreement for operating the Account and to delete the Account.
- Deletion of the Account results in the cessation of public sharing of the User's Video Materials. The rules for storing and deleting data after termination of the agreement are set out in the Privacy Policy.
§ 14. Complaints
- The User is entitled to lodge a complaint regarding the Services, including decisions taken under § 12, at the address rada-starszyzny@plonhub.com.
- A complaint should contain data enabling contact with the User and a description of the objections. The Service Provider examines the complaint within 14 days of its receipt and informs the User of the manner of its resolution.
§ 15. Consumer rights
- A Consumer who has concluded an agreement for operating an Account at a distance is entitled to withdraw from it within 14 days of its conclusion, without giving a reason, by submitting a statement to the address rada-starszyzny@plonhub.com. Sending the statement before the deadline expires is sufficient to meet the deadline.
- The Services are provided to the Consumer from the moment of conclusion of the agreement, with the Consumer's express consent given upon registration. The Consumer acknowledges that, upon full performance of the Service by the Service Provider, they lose the right to withdraw from the agreement.
- The Consumer is entitled to use out-of-court methods of handling complaints and pursuing claims, including the online dispute resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.
§ 16. Personal data and cookies
- The controller of Users' personal data is the Service Provider.
- The rules for processing personal data and the use of cookies are set out in the Privacy Policy, available at plonhub.com.
§ 17. Amendments to the Terms
- The Service Provider is entitled to amend the Terms in the event of: a change in the law affecting the provision of the Services; a change in the scope or manner of providing the Services, including the introduction of paid Services or advertising functions; a change in technical requirements; or the need to implement a decision of an authority or a court judgment.
- The Service Provider informs Registered Users of an amendment to the Terms no later than 14 days before the date the amendment enters into force, by electronic means to the e-mail address assigned to the Account or by a notice in the Service.
- A Registered User who does not accept an amendment to the Terms is entitled to terminate the agreement for operating the Account with effect as of the date the amendment enters into force, by deleting the Account.
§ 18. Final provisions
- The Terms are in force as of 5 June 2026.
- The Terms are governed by Polish law. The choice of Polish law does not deprive a Consumer of the protection afforded to them by provisions that cannot be derogated from by agreement under the law in force in the country of their habitual residence.
- Disputes with a User who is not a Consumer are resolved by the court having jurisdiction over the Service Provider's registered seat.
- The Terms have been drawn up in a Polish and an English version. In the event of any discrepancy, the Polish version shall prevail.
- Should a provision of the Terms be found invalid or ineffective, the remaining provisions remain in force, and the Service Provider shall replace such provision with one of the most similar purpose.
